The Cleveland official instead awarded Blues a free-kick as Gallas handled the ball when stumbling.
"I just saw two players get tangled up and William (Gallas) fell on the ball and had it between his hands so obviously I gave a free kick for handball against him," Winter told Sky Sports after the game.
"Having looked at it again on the tv that to me wasn't a clear-cut penalty. Two of the players got tangled-up and went to ground so I'm quite happy with that decision."
