Blues boss Steve Bruce will defend the French striker at the hearing at the Hawthorns having claimed Dugarry is being harshly treated.
"I don't really think that Christophe has got anything to answer for," said the Blues boss.
"We believe that he is innocent and what he did was a gesture.
"He actually didn't spit at the player. It was a gesture and we will try and prove that.
"But whatever happens I don't think it will affect how he feels about England. I don't think so. He is man enough to take it if he is punished - he's had suspensions before."
